The purchase of a trip executed by Japan Ikigai Trip represents your acceptance of these terms.

USE OF THIRD-PARTY SUPPLIERS. Japan Ikigai Trip is not a travel provider. In making reservations and other travel arrangements on behalf of its customers, Japan Ikigai Trip acts as an agent of various third-party suppliers, such as airlines and hotels, who are independent of Japan Ikigai Trip. Such third-party suppliers are exclusively responsible for providing services contracted for, including, but not limited to, transportation, lodging, and meals. Japan Ikigai Trip maintains no control over the operation, equipment, or personnel of such suppliers and therefore assumes no liability or responsibility for any personal injury, property damage, or other loss, accident, delay, or inconvenience caused by any wrongful or negligent act or omission on the part of any service provider. You agree to look solely to the actual suppliers of the services for any remedy in the event of any loss, damage, injury, or claim.

PAYMENT TERMS. Japan Ikigai Trip accepts payments via credit card. In providing payment to Japan Ikigai Trip via credit card to book your trip, you attest that (i) the credit card information you supply to us is true, correct, and complete; (ii) you are duly authorized to use such credit card for the purchase; (iii) charges incurred by you will be honored by your credit card company; and (iv) you will not initiate a chargeback.

TRAVEL DOCUMENTS. It is the passenger’s responsibility to have a valid passport and state identification. You agree that Japan Ikigai Trip is not responsible if you do not have the correct documentation for the type of trip you requested.

SATISFACTION. By purchasing a mystery trip executed by Japan Ikigai Trip and agreeing to these terms and conditions, you give Japan Ikigai Trip permission to select the destination for your trip and relinquish control over your destination. As such, you acknowledge the inherent risk that you may be dissatisfied with the destination or other aspects of the mystery trip. Japan Ikigai Trip is not liable if you are dissatisfied with your trip and will not offer refunds under these circumstances.

CANCELLATIONS AND RESCHEDULING. If you need to cancel or reschedule your trip, we will assist you in securing any refunds by airlines, hotels, and any other suppliers and vendors. However, we cannot assure a complete refund. You will remain responsible for any cancellation fees imposed by the suppliers and vendors. When rescheduling your trip, changing your trip may necessitate booking new flights, as existing flights cannot be modified. Consequently, you’ll be required to cover at least the cost of your current flights when making changes. Additionally, any additional costs associated with date changes will be your responsibility, although we strive to minimize these costs whenever possible. In addition, you will remain responsible for payment of Japan Ikigai Trip’ service fee(s) for the work done to research, plan, and book your trip, as well as seek any applicable refunds on your behalf in the case of cancellation and rescheduling

FORCE MAJEURE. Japan Ikigai Trip will not be liable or responsible, nor deemed to have defaulted or breached these terms, for any failure or delay in our performance when such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, pandemic, lockouts, strikes or other labor disputes, or restraints or delays or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdowns, or power outages.

ATTORNEY FEES. In the event of an action to enforce this agreement or to seek remedies for breach of this agreement, including the failure to make timely payment, the prevailing party shall be entitled to recover from the other party its costs, disbursements, and reasonable attorney fees.

GOVERNING LAW AND JURISDICTION. This agreement and any disputes arising in connection herewith shall be governed by the laws of the State of Virginia, without regard to its conflicts of laws principles. All actions relating to this agreement shall be brought and tried in the state or federal courts of Virginia. The parties hereby consent to submit to the personal jurisdiction of such court and to venue therein.

LIMITATION OF LIABILITY. To the fullest extent permitted by law, Japan Ikigai Trip shall not be liable to you for any claims for damages, including punitive, indirect, direct, speculative, or any other form of cognizable damage beyond the total amount paid by you for the services provided hereunder.

COVID-19. You, the traveler, recognize there is an inherent risk of disease or illness inherent in all travel, including when booking your vacation with Japan Ikigai Trip during the COVID-19 pandemic. As the traveler, you assume personal responsibility and acknowledge that Japan Ikigai Trip is not liable for exposure or potential exposure to illness, including COVID-19, before, during, or after travel. You, the traveler, also acknowledge that you assume personal responsibility for understanding the travel requirements and travel risks. Japan Ikigai Trip is released of all liability in regard to changes or cancellations made as a result of COVID-19, including circumstances in which the traveler has failed to complete the necessary requirements or taken the appropriate measures per destination protocols. The traveler assumes all personal responsibility for any legal consequences or other ramifications of not following such protocols and local ordinances of their travel destination as it relates to COVID-19.
